VCAT template support letter

This template support letter is targeted toward a hearing where your client is facing eviction.

At an eviction hearing, VCAT must consider whether it is reasonable and proportionate to make a possession order against your client. As part of this, they must consider numerous factors including the impact of eviction on your client and any ability to resolve issues that have led to the eviction proceedings. We refer to this as the ‘Reasonable and Proportionate test’.

The ’Reasonable and Proportionate test’ is dealt with on a case-by-case basis. Your support letter can help outline your client’s circumstances or vulnerabilities, their engagement with services, steps they’ve taken to comply with their obligations and the impact eviction will have on them. This may help them get a positive outcome at VCAT.

Provide this to the lawyer assisting your client. If your client doesn’t have legal assistance send it to VCAT before the hearing: renting@vcat.vic.gov.au.
